The ECtHR made 47 decisions related to Ukraine

From January 1 to March 31, 2025, the European Court of Human Rights (ECtHR) made 47 decisions related to Ukraine. Of these, 17 concern violations of Article 5 of the Convention.

Margaryta Sokorenko, the authorized representative in matters of the ECtHR, reported this and emphasized that many of these cases could have been avoided if the Court's conclusions had been taken into account and all ECtHR standards had been observed.

'A significant number of such cases could have been avoided if the Court's conclusions had been fully taken into account and all fundamental ECtHR standards had been adhered to,' she noted.

There is one key ECtHR standard - the substantiation of suspicion as a basis for arrest. The Court pays special attention to whether there are sufficient facts and evidence to justify the necessity of keeping a person in custody.

The authorized representative also noted that not every application to the ECtHR ends with a recognition of a violation by the state. For example, last year a decision was made in favor of Ukraine in several cases where all guarantees were observed. This is evidence that national courts can act in accordance with international standards, and the choice of preventive measures can be duly justified.
